Jay Cohen believed that since his business was not based in the US, he was not subject to the laws that forbid sports bets made through any sort of communications device. He however decided to fight the charges, but he lost the case and was convicted in 2000, sentenced to 21 months in prison with a fine of $5000. The Effect of UIGEA on WSEX

On October 13, 2006, President George Bush passed the Safe Port Act of which UIGEA (Unlawful Internet Gambling Enforcement Act) was a part. The UIGEA deemed it illegal for banking institutions to handle gambling related transactions. As a result, a number of payment processors stopped servicing the US markets; notable among them was Neteller which was indicted and pulled out abruptly in 2007.

After the UIGEA, many banking processors were not willing to handle American gambling related transactions. As a result, WSEX began facing processing issues. Additionally, Jay Cohen’s case showed that online sports betting were illegal in the United States, so WSEX had major problems in dealing with payments to their customers. They had to make do with very few payment processors and pay high processing fees. They also faced problems with processors defaulting on payments or inexperienced in fighting fraudulent players.

WSEX now appointed an electronic check processor to deal with US players. Players could directly deposit funds via the e-checks. The arrangement continued for a few months but soon it failed. WSEX was left holding the e-checks because the deposits could never be collected from the failed processor. This was the beginning of the end for WSEX.

Rake-Back Poker at WSEX

In 2006, WSEX launched rake-back scheme in their poker room known as the World Poker Exchange (WPEX). The idea was to attract customers to their poker room and ultimately popularize the WSEX brand. WPEX offered 100% rake-back of the entire rake contributed to the pot from Monday to Sunday. In other words, the site offered rake free poker. The poker software however was incapable of handling the rush of players; there were problems with bots and collusion while players experienced crashes and slow performing computers.

In 2007, WSEX decided to stop the rake free poker and by 2008 was again functioning as a full rake poker room. There was hardly any traffic and they failed to bring in the money and the action into the sportsbook though the poker rake-back offer.

Payment Slowdown at WSEX

In 2008, the payouts to the winners began slowing down. WSEX said they were facing problems due to lack of payment processors. Another watchdog site, sportsbookadvisor.com has downgraded it to F grade, effectively blacklisting it. Currently, WSEX owes more than $700,000 to players. WSEX did not apply for the renewal of its Antigua gaming license when it expired in 2010. So, presently, it is an unlicensed sportsbook rumored to be operating underground from Antigua. The site however, claims to be licensed in Cyprus with a London postal address.

Although the once renowned World Sports Exchange is now completely bankrupt, they are still making attempts to make good on their promises. • If two or more players are eliminated in the same hand, the players’ final positions are determined by who had the largest number of chips at the start of the hand. If the players started the hand with an identical number of chips, they finish in a tie and any prizes are equally distributed between them.
• World Poker Exchange uses the same procedure for blinds in tournaments as in our ring games. We move the dealer button after every hand and attempt to ensure that no player misses posting his/her blinds. However, there are occasions on which a player may hold the button twice consecutively, or on which the button is at an empty seat. As these are basically random occurrences, no player will receive any long-term advantage, and this format is fair for all players.
• When two players remain, the button posts the small blind and acts first in the opening round.
• Disconnects:
  • By participating in a tournament, a player accepts the risk of Internet disconnection due to problems with the connection between his/her computer and the server, lag, freezing, or other problems with the player’s computer. World Poker Exchange accepts no responsibility for player disconnects, except in the case of a server crash.
  • If a player times out during a hand, whether connected or disconnected, his/her hand will be folded.
  • If a player is not connected before a hand starts, he/she will be dealt cards and his/her blind and/or ante will be posted. There is no rule against choosing to sit out; a player doing so will continue to have his/her blinds and antes posted and cards dealt.
• Soft playing and chip dumping are grounds for disqualification from a tournament. Any unethical play may result in termination of the offender’s account.
• In structured-limit tournaments, a bet and three raises are permitted in each round. There is no raise cap in pot-limit or no-limit tournaments.
• As players are eliminated from a tournament, our software may move players to other tables in order to ensure that all tables have as close to an equal number of active players as possible. Such “balancing” of tables is done randomly, and may in rare cases result in a player having to post big blinds in consecutive hands. When 10 players remain in a Texas Hold ‘em or Omaha tournament, or eight players remain in a Seven-Card Stud tournament, all players are brought together at the final table.
• Prizes will be awarded as specified in the tournament lobby.
• In the event of a server crash, the hands in progress at each table will be restored by rolling such hands back. Each player’s chip count will be reset to the amount at the beginning of the hand. Under special circumstances, when it is impossible to restart a tournament following a server crash, the tournament will be cancelled and the unclaimed portion of the prize pool will be equally divided among all remaining players.
• Players and observers are expected to use the chat feature in a courteous manner.
• Regardless of whether they are involved in the hand, players may not discuss a hand until the action is complete. Players are obligated to protect the other players in the tournament at all times. Discussing discarded cards or hand possibilities is not allowed. A penalty may be imposed for discussing a hand during play.
• During tournaments, we offer a 5 minute break every 60 minutes of play.
• For most tournaments, a player can unregister up to 10 minutes before the start of the tournament.
• In cases of disputes, the decisions of the management of World Poker Exchange will be final.

The minimum number of registered players required for any MTT to start is set at different levels. Please see schedule below for Minimum number of Registrants required. If the minimum number is not reached by the start of a tournament, the tournament will be cancelled and the buy-in amount will not be deducted from any player’s account.
